You agree, without limitation or qualification, to be bound by this policy and the terms and conditions it contains, as well as any other additional terms, conditions, rules, or policies that are displayed to you in connection with this service/website, by accessing this website or by making a service agreement with us.
This Acceptable Use Policy ('AUP') is intended to comply with applicable Federal Republic of Nigerian laws, to make clear to customers and users of our service/website what behaviors are considered to be unacceptable uses of the service/website, to safeguard the security of our network, and to outline the potential repercussions of engaging in such prohibited activities.
You should be aware of the various legal duties included in this publication. As a result, we urge you to carefully read this document and contact our customer service department with any questions at 08071781998, 012272300, Sales@dbm.ng.
In accordance with our constitution, Direct Broadband respects the rights of its customers and other users of its services to freedom of speech and expression, information access, privacy, human dignity, and expression of their religious and philosophical beliefs. We agree not to impede on any of those rights unless legally mandated, when doing so would endanger the safety of others or compromise the integrity of our network, or when those rights are being used for illegal activities.
Use that are illegal
The only authorized uses of Direct Broadband's services are legitimate business endeavors. We forbid anybody from using our website or network in a way that violates any laws or regulations of the Federal Republic of Nigeria, including by transmitting, storing, or disseminating any materials or content over our network.
This includes:
- Any act that violates local, national, or international laws against child pornography, obscenity, discrimination (including racial, gender, or religious slurs), hate speech, or threats to harm one's physical safety.
- Any action intended to slander, mistreat, stalk, harass, or physically endanger any person within the Federal Republic of Nigeria or outside its borders, including any attempt to link to, post, send, or otherwise disseminate any improper or slanderous content.
- Any infringement on anything protected by intellectual property laws, such as trade secrets, trademarks, and copyrights on a national and international level. Furthermore, whether for profit or not, Direct Broadband cannot be held responsible if you utilise any multimedia content obtained through the network's search function or in any other way through access to our network for any illegal activity.
- Any infringement of a person's right to privacy, such as attempting to get another person's personal information without that person's permission.
- Phishing attempts, advance-fee fraud schemes, or any other attempt to transact with Direct Broadband on another subscriber's behalf without that subscriber's consent; any questionable financial practices, such as pyramid schemes; impersonating another subscriber without that subscriber's consent; or any other fraudulent activity of any kind.
- Any infringement of the Federal Republic of Nigeria's exchange control laws.
- Ignoring a request from a receiver of unwanted mail to be taken off any mailing or direct marketing list and continuing to send unsolicited mail after receiving such a request to be taken off.
- Any action that leads to the purchase, transfer, or distribution of unauthorized or piratical software.
- Any user who resides outside of the Federal Republic of Nigeria, whether permanently or temporarily, will be governed by the laws of the nation in which they are presently residing. Direct Broadband will assist foreign law enforcement agencies (LEA) in the investigation and prosecution of a crime committed using Direct Broadband's resources, including the provision of all personally identifiable information, upon presentation of a legal order to do so or under obligation through an order for mutual foreign legal assistance.
Prohibited conduct
The standards for proper use of particular facilities or services, where applicable, are detailed in the parts that follow. They also list actions that are deemed an improper use of Direct Broadband's services, network, or website.
Network security threat
Anything that jeopardizes the integrity, security, or operation of Direct Broadband's network is unacceptable. Among them are:

Any attempt to overcome user authentication or security of any host, network, or account using Direct Broadband's hardware ("cracking" or "hacking");
- Any efforts to attempt to gain unlawful and unauthorized access to the network or circumvent any of the security measures established by Direct Broadband for this goal;
- Any attempt to compromise the security of another user's account or to access another user's computer, software, or data without that person's knowledge or authorization;
- Any action that poses a risk of interfering with Direct Broadband's ability to provide its service, such as "denial of service attacks," overloading or flooding a network, or unauthorized probing ("scanning" or "nuking") of other networks;
- Any conduct that knowingly distributes data or software that contains a virus, Trojan horse, worm, lock, mail bomb, cancel-bot, or other harmful, disruptive, or disruptive component. This includes posting, transmitting, linking to, or otherwise sharing such data or software.
- Any unapproved observation of data or network traffic without Direct Broadband's express, written approval.
- Any unsolicited mass mailing activity for commercial or other objectives, without the recipients' consent, such as direct marketing, spam, and chain letters.
Unsolicited, spam and junk mail
Unwanted bulk mail and spam are really bad practices. They frequently jeopardize network security and have an impact on how others use and enjoy services. Any user participating in any of the following prohibited behaviors will be subject to fast and stern repercussions from Direct Broadband:
- Sending bulk unsolicited mail to non-consenting recipients for marketing or any other reason (political, religious, or commercial);
- Delaying the removal of invalid or undelivered addresses, addresses of unwilling recipients, or addresses of a recipient who has requested to be taken off a list;
- Whether an unsolicited email is sent through Direct Broadband's network or not, it should include Direct Broadband's name in the header or include a Direct Broadband owned IP address;
- Using Direct Broadband's service to gather feedback on unsolicited email sent from accounts on other Internet hosts or email services, which is against this AUP or the AUP of any other Internet Service Provider;
- Using or maintaining mailing lists without receiving each recipient's explicit consent;
​Virus/Spam Filtering
To protect consumers from unwelcome mail and viruses, Direct Broadband offers a spam and virus screening system. The customer understands that this system may wrongly identify a valid message as spam or a virus, resulting in the message not being sent to the customer. The customer acknowledges and accepts the Direct Broadband will have no responsibility or liability for any data lost as a result of this technology.
DirectBroadband maintains the right to thoroughly review any incoming or outgoing message to decide if it qualifies as spam.
Protecting Minor
Direct Broadband bans users from using its service to damage or attempt to harm a minor, including but not limited to hosting, having, disseminating, distributing, or transferring illegal material, including child pornography.
Privacy and Discretion
Direct Broadband respects our customers' and users' privacy and confidentiality. Please read our privacy statement, which explains how we collect and utilize personal information acquired while providing this service.
User Responsiblity
Customers are liable for any unauthorized use of Direct Broadband services through their accounts. It is the duty of the customer to guarantee that unauthorized individuals do not obtain access to or misuse Direct Broadband's service.
Customers are urged by Direct Broadband not to respond to "spam" or unsolicited mail and not to click on any suggested links that may be included in the unsolicited letter. The customer is still solely responsible for doing this, and Direct Broadband is not accountable if this results in the customer getting added to any mass mailing lists.
As the parent or legal guardian of a minor who has been given permission to use any of Direct Broadband's services its websites, you accept responsibility for that minor's online behavior, for restricting access to and use of any services or websites, and for any misuse of those services or websites by the minor, including but not limited to any transactions made by the minor using such access.
Direct Broadband disclaims all responsibility for your interactions with any vendors or advertising you may come into contact with on the Internet or through the Direct Broadband network. Additionally, Direct Broadband disclaims all liability for any fees you or any other user of your account may pay when making purchases or engaging in other activities in this way. Additionally, it is the customer's responsibility to make sure that all applicable customs and exchange control rules are followed in conjunction with any such transactions.
Complaint and Procedures
The client is in charge of becoming familiar with the process outlined below and notifying DirectBroadband's designated complaints handling agent of any instances of this AUP violation.
Please be aware that Direct Broadband is unable to respond to complaints about users or networks that are not covered by agreements with us or our affiliates or that are not under our control.
All complaints must be submitted in writing, by fax, or email and include as much detail as possible so that Direct Broadband can fully investigate them and take the necessary action, including but not limited to:

any information on how to reach the complaint's originator;
- the source of the offense or abuse, including the URL, complete mail headers, pertinent log file excerpts, etc.;
- a brief explanation of why the incident is deemed a crime.
Direct Broadband strongly advises users to provide their name and contact information to us instead of submitting anonymous complaints using this service. Except in situations when law enforcement requires it, such information won't be disclosed. However, anonymous complaints will be investigated if they include the necessary information, as described above.
Actions taken in response to an AUP violation
Direct Broadband may take any of the following actions upon receiving a complaint or becoming aware of an incident:
- In the event of network abuse, notify the user's network administrator and request that the network administrator or network owner address the situation in accordance with this AUP and the NCC Code of Conduct.
- In the event of individual users, issue a warning; suspend the user's account; and/or totally remove or cancel the user's network access credentials.
- Share information about the occurrence with other Internet service providers, or publish it, and/or make the users' information available to law enforcement organizations.
- Assist other network or website administrators in conducting credible investigations into any of the activities described in this AUP;
- Charge the guilty parties for administrative costs as well as machine and human time lost as a result of the occurrence in all situations.
- Launch civil or criminal actions;
Reservation and Waiver-Prohibited Right
Without giving you any notice, Direct Broadband maintains the right to change or modify this policy at any moment.
Direct Broadband retains the right to pursue legal action to the fullest extent of the law against any persons, businesses, or other entities who engage in any of the prohibited conduct stated below or otherwise access our services unlawfully.
Direct Broadband reserves the right to take action against such abuses not covered in this text and to look into or stop unlawful acts from happening on our network, at its sole discretion.
If providing service to the subscriber/user puts the safety and integrity of Direct Broadband's resources at risk, Direct Broadband retains the right to stop, revoke, or terminate its services to the customer/user.
It is not the responsibility of Direct Broadband to ensure the security of any data traveling over its networks. Despite making a "best effort" to provide a service that includes regular updates on computer viruses and other threats to the security of data, Direct Broadband cannot be held liable for any loss or damage resulting from the communicating parties' failure to protect their data.
In the event that Direct Broadband is unable, unwilling, or unable to enforce a violation of the AUP at any time, Direct Broadband does not forfeit the right to later take further action.

Direct Broadband retains the right to monitor user- and network traffic for site security purposes and to prevent unauthorized attempts to tamper with or damage our property.
Fair Policy Use
Direct Broadband is glad to announce that bandwidth constraints on down-load and up-load have been removed from its Smart Home Plan. Customers can use the bandwidth without fear of being throttled, shaped, competed, or limited. Direct Broadband reserves the right to restrict user usage or speed in accordance with our Acceptable Use Policy (AUP), which may be read on the Direct Broadband website.
We have adopted a Fair Usage Policy based on our Direct Broadband Uncapped product offering due to the way Direct Broadband provides FTTH services and the accompanying cost. Direct Broadband's fiber line may vary due to constraints associated with their FTTH network..
The broadband access service is delivered on a shared, "best efforts" and contended network with minimal service assurances that may be influenced by other customers' activities.
Direct Broadband reserves the right, and will take appropriate steps, to prevent excessive usage in order to ensure that all customers have fair and equal access to the service and to safeguard the network's integrity.
There will be no additional restrictions or limitations placed on the line while it is rate limited, and the connection will remain uncapped and unshaped during this time. Direct Broadband's actions may include, but are not limited to
Sharping Throughput
Services that use specified ports or communication protocols are prioritized.
Rate Limiting Throughput
This policy applies to and will be enforced for both intended and unintended excessive usage (e.g., viruses, worms, malicious programming, or other unknown reasons). Direct Broadband may request that the source of the unwanted consumption be removed if excessive usage is the result of unintended usage.
Technical Measures to Prevent Abuse of Broadband Access Service
Direct Broadband reserves the right to take any action necessary to maintain the integrity of the Direct Broadband Network, such as system monitoring, protocol management, and the shutdown of ports infected with viruses, worms, or other malicious code.
Legal Right
Any changes to this policy made by Direct Broadband are subject to immediate implementation upon posting to the Direct Broadband website.
